For many of the children we represent, this fear isn’t just about being deported—it’s about losing their families, their schools, and their sense of safety overnight.
A Family’s Presence Can Change in an Instant
One of our clients—a father of four U.S. citizen children—was taken into ICE custody while leaving his job. His children haven’t seen him since. Their mother, who is struggling with severe anxiety, calls us regularly, asking if there’s anything new. Their home is quiet now, their routines disrupted, their hope thinning by the day.
Unfortunately, this case is no longer rare. We’re seeing more cases like this every week: individuals with no criminal records, in full compliance with immigration procedures, being arrested during routine activities—school drop-offs, grocery store visits, even medical appointments.
Immigration Raids Are Happening Where Families Live
What used to be limited to border zones is now happening inside city limits. Immigration enforcement officers, often in plain clothes, have begun appearing in residential neighborhoods, sometimes requesting to inspect rooms or speak with children directly. In some cases, they’ve arrived with no warrants, attempting to intimidate caretakers into allowing access.
The psychological toll is enormous. Children refuse to answer doors. Parents hesitate to take their kids to school. Entire communities are pulling back from daily life—not because of official policy, but because of how policies are being executed.
Children Are Facing Immigration Court Alone
Perhaps the most alarming development is the use of “rocket dockets”—fast-tracked court calendars that assign immigration hearing dates within days or weeks of apprehension. Many of these children are under 12 years old. Some are as young as 4.
In too many cases, these children are being asked to navigate the legal system without representation. Even those with pending applications for relief—such as asylum or Special Immigrant Juvenile Status (SIJS)—are often rushed through hearings, leading to rushed denials or automatic removal orders.
For children with trauma histories, language barriers, or learning difficulties, this is not a process—it’s a pipeline to deportation.
Legal Support Is Being Cut Where It’s Needed Most
Government programs that once funded legal aid for children and youth have been suspended or dramatically reduced. At the same time, detention facilities have raised sponsorship requirements, making it harder for even biological parents to bring their children home from custody.
In one case, a teenage boy we represent has been sitting in a Texas detention facility for over 90 days, even though his aunt—his only living family—has already been vetted and approved as a sponsor. Due to new verification delays and excessive red tape, his release keeps getting pushed.
Families Are Avoiding Hospitals and Schools
Public trust is breaking down. We’ve heard from parents who refuse to take their children to the doctor, even during medical emergencies, because they fear being reported. While some protections exist under state law, enforcement practices have created such uncertainty that many families feel every institution is a risk.
Schools are reporting declining attendance, especially in elementary grades where children are less able to advocate for themselves. Teachers and administrators are trying their best, but the legal climate is creating barriers that no classroom can solve.
Even Court Compliance Has Become Dangerous
In the past, we advised clients to appear at every scheduled court hearing, no matter what. Today, that guidance has become more complicated. We’ve seen cases where individuals show up for their hearings only to be detained immediately afterwards. Some of these individuals had valid applications pending. Others were attending interviews or check-ins as required by law.
This shift has made immigrants fearful of the very system that should offer due process. Families are now forced to choose between showing up and risking separation—or staying away and receiving a default removal order. Neither option protects them.
The Emotional Impact Is Hard to Measure
As lawyers, we often talk about legal status, petitions, and case timelines. But behind every case file is a child trying to sleep at night, wondering if their parent will still be there in the morning.
We’ve met kids who carry copies of their birth certificates in their backpacks, hoping it might somehow protect them. We’ve worked with teens who can’t focus in school because they’re now the head of their household. This is not how any child should have to live—yet for thousands in Texas, it’s the new reality.
